Products Liability

A Products Liability claim arises from an individual being injured or suffering other damages because of a defective product.  However, you must also show not only that you suffered losses and the product was defective, but that the defect caused your injury and that you were correctly using the product as it was intended.  There are many rules and regulations regarding product liability claims such as not only the statute of limitations, which only gives you a limited amount of time from which to file your cause of action, but also a statute of repose which limits the time a person may file an action for a defective product from the date of manufacture or the day it was put in the stream of commerce.  Therefore, if you believe you have been injured by a defective product it is recommended that you seek consultation and legal advice to review your rights and remedies.
